There are three primary types of Patents that we handle on a day to day basis; Utility Patents, Design Patents, and Plant Patents.

Over 90% of the Patents that the United States Patent and Trademark Office (USPTO) have issued over the past decade are Utility Patents. An individual or a business would apply for a Utility Patent when they have an invention that is of a new and useful process, a machine, a manufacture, or a composition of matter. Once this type of Patent is issued the owner will have exclusive use of the invention for up to 20 years of the application date.

A Design Patent is the second most commonly issued Patent by the USPTO. An individual or business would apply for this type of Patent for a new, original, and ornamental design that is embodied in or applied to an article of manufacture. This type of Patent will give the owner exclusive use of the design for up to fourteen years. However, it is prudent to point out that this period of time may change in the near future.

In order to have this type of Patent issued, an individual or business must show that they have found or invented a plant that is new and distinct, invented or discovered asexually reproduced which includes mutants, cultivated sports, newly found seedlings, and hybrids.
