If you have ever looked closely at the name or slogan of a business you may have noticed an “R” encompassed by a circle, “SM” or “TM”, right after the name or logo. The “R” with a circle around it means that the name is registered with the United States Patent and Trademark Office (USPTO). The “TM” logo stands for trademark and while the “SM” stands for service mark, both of which must be registered with the USPTO.
There is a lot of flexibility in how and where to use the TM, SM or ® symbols. More times than not, the symbol would be placed in the upper right of the logo of the business. However, there is no rule that it must be placed there. Here is an example of one of the most widely known registered ownerships; COCA-COLA®.
