The United States Patent and Trademark Office released an agency-wide artificial-intelligence strategy intended to guide both internal adoption and broader intellectual-property policy.

The strategy addresses the development of AI-related IP policy, investment in data and computational capabilities, responsible deployment of AI tools, workforce education, and collaboration with domestic and international stakeholders.

For applicants, improved agency technology could eventually support faster searching, more consistent examination, and better access to information. At the same time, automated tools must be implemented carefully so that transparency, accuracy, due process, and human review remain central to decision-making.

The initiative also recognizes that the USPTO must build technical expertise as AI affects patents, trademarks, copyright-adjacent issues, and trade-secret strategy. Examiners and policymakers need to understand both the capabilities and limitations of rapidly changing systems.

Companies developing AI should monitor how USPTO guidance evolves. Changes in subject-matter eligibility, inventorship, disclosure expectations, examination practices, and trademark review may affect filing and portfolio strategy.

The strategy signals that AI will influence not only the inventions submitted to the USPTO but also the way the agency itself operates. Innovators should expect continued guidance and should build flexible IP strategies that can adapt as policy and examination practices develop.
