Understanding The Amazon APEX ID: A Powerful Tool For Utility Patent Protection For Amazon Sellers

An Amazon APEX ID can help utility patent owners enforce their patent rights on the Amazon platform. It is a unique identifier associated with Amazon’s Patent Evaluation Express program.

What Is an Amazon APEX ID?

The APEX ID is issued for utility patents after a patent owner successfully completes an APEX proceeding. The program provides a relatively fast way to address products alleged to infringe a utility patent.

How Is an APEX ID Obtained?

An APEX ID is not automatic. The accused seller must participate in the proceeding, and the neutral evaluator must find that the accused product infringes the asserted patent. If the seller declines to participate, the listing is generally removed, but an APEX ID may not be issued.

What Rights are Covered?

The APEX ID is available only for utility patents. It is not available for design patents, trademarks, or copyrights.

How Does The APEX ID Help?

Who Can Initiate an APEX Proceeding?

The owner of a U.S. utility patent, or counsel acting for that owner, may initiate the process. The complaint identifies allegedly infringing products by Amazon Standard Identification Number, and up to fifty listings may be included.

How The Proceeding Works

If both parties participate, each deposits $4,000 and Amazon appoints a neutral patent attorney. The patent owner submits its infringement arguments, the accused seller responds, the patent owner may reply, and the evaluator issues a decision. The prevailing party receives its deposit back.

If infringement is found, the accused listings are removed. The evaluator’s decision cannot be appealed within the APEX process, though either side may later pursue federal litigation.
