Understanding Restriction Requirements in Patent Prosecution: Why They Arise, How to Respond, and Strategic Considerations

In patent prosecution, the USPTO may issue a restriction requirement when an application claims multiple independent or distinct inventions. The applicant must then elect one invention for examination.

The authority for restriction practice arises under 35 U.S.C. § 121. An applicant may elect without traverse, accepting the restriction, or elect with traverse while challenging whether the inventions are truly distinct.

A reasoned traverse can preserve the ability to challenge the restriction later. Failing to traverse when appropriate may waive that opportunity, so the relationship among the claims and the commercial value of each invention should be carefully evaluated.

Non-elected claims are withdrawn rather than abandoned. They may be pursued through divisional applications or coordinated continuation strategies. Properly filed divisionals may also receive protection from certain double-patenting rejections under § 121.

Rejoinder can sometimes return withdrawn claims to the original application after elected claims become allowable. Applicants should monitor eligibility for rejoinder and maintain claim sets that preserve this possibility.

A restriction requirement can ultimately support a family of related patents. The response should balance timing, cost, product coverage, enforcement value, and long-term portfolio goals.
