Sonos’ Landmark Appeal Victory in Patent Dispute With Google: A Game-Changer For Small Innovators

The Federal Circuit reversed a district court decision that had set aside Sonos’s $32.5 million jury verdict against Google and treated the asserted patent as unenforceable under prosecution laches.

The dispute concerned Sonos’s “zone scenes” technology for synchronizing groups of wireless speakers. Although the district court focused on the length of Sonos’s continuation practice, the appellate court concluded that delay alone was not enough.

The ruling explained that a party asserting prosecution laches must establish both unreasonable delay and actual prejudice. Google did not show that Sonos’s prosecution timeline misled it or caused it to change its behavior in reliance on the delay.

For smaller innovators, the decision reinforces that properly maintained continuation applications can remain enforceable. It also highlights the importance of transparent prosecution, careful records, and a litigation strategy prepared to address equitable defenses.
