Reading a Patent Document Like a Pro: How to Quickly Understand What a Patent Covers

Utility patents are dense legal and technical documents. A reader does not always need to study every page to gain a useful general understanding of what a patent covers.

Start With The Purpose of The Review

The reading approach depends on the question: potential infringement, patentability over prior art, enforceability, or simply a general understanding of the disclosed technology.

Identify The Document Type

U.S. design patent numbers typically begin with “D,” plant patents with “PP,” and utility patent publications often use a format such as US 2002/0123456 A1. A published application is not necessarily an issued patent. Granted utility patents use sequential numbers and may end with a code such as “B2.”

Read The Title and Abstract

The title gives an initial indication of the invention. The abstract summarizes the technical disclosure, but it does not necessarily define the full legal scope of protection.

Move to The Claims

The claims define the legal boundaries of the patent and are the most important section for evaluating scope and possible infringement. They generally appear near the end of the document.

Use The Detailed Description and Figures

If a claim term is unclear, consult the detailed description. The figures can then help explain the invention’s structure, components, and operation.

Conclusion

For a quick general review, read the title, abstract, claims, relevant description, and figures—in that order—while keeping the purpose of the analysis in mind.
