How Understanding Intellectual Property Can Supercharge Innovation—Especially in The Age of AI

MARK TERRY, ESQ.

Innovation depends on more than a strong idea. Businesses also need a plan for converting new products, creative works, brands, data, and internal methods into assets that can be protected and used strategically.

Patents, trademarks, copyrights, and trade secrets each serve a different purpose. Together, they can help a company preserve exclusivity, strengthen its position with investors and partners, reduce exposure to copying, and create licensing or commercialization opportunities.

For startups, early intellectual-property planning can be especially important. Identifying protectable assets before public disclosure, product launch, or outside collaboration can preserve options that may otherwise be lost and can make a company more attractive during fundraising and due diligence.

Artificial intelligence adds a new layer of complexity. Businesses increasingly use AI for software development, content creation, data analysis, automation, and product design, but questions about ownership, authorship, training data, and infringement remain unsettled in many contexts.

A company using AI should therefore evaluate both opportunity and risk. That may include documenting human contributions, reviewing third-party licenses and platform terms, protecting confidential workflows, and deciding whether patent, copyright, trademark, or trade-secret protection best fits the asset involved.

The most successful innovators tend to treat intellectual property as part of product and business strategy rather than as a legal task postponed until after launch. A proactive approach can create clearer ownership, stronger market positioning, and more durable long-term value.
