How to Handle Design Patent Infringement Complaints on Amazon

If you sell products on Amazon, receiving a design patent infringement complaint can temporarily shut down listings, reduce sales, and damage your reputation. Understanding the complaint and responding carefully can help resolve the issue.

1. Understand The Complaint

A design patent protects how a product looks rather than how it functions. Identify the U.S. design patent number, review the patent through the USPTO, and study its drawings and claim. If the complaint lacks necessary detail, request more information from Amazon.

2. Determine Whether Your Product Infringes

  • Ordinary Observer Test: Would an informed ordinary observer consider the accused and patented designs substantially the same?
  • Prior Art: Earlier similar designs can narrow the patent’s scope and affect the comparison.
  • First-Sale Evidence: Records showing sales before the patent’s filing date may support a defense.
